Terms of service
1. Who these terms are between
These terms govern use of the YouTube Creator Sourcing Console (“the Service”), operated by Juhas Digital Services s.r.o., a company registered in Slovakia with its registered office at Sukennicka 1, 82109 Bratislava, Slovakia (“we”, “us”).
2. What the Service is
The Service is an internal business tool. It searches publicly available YouTube data to identify channels that may be suitable partners for marketing campaigns, records what it found and why, and presents the result to our team for a human decision. It is not offered to the general public and there is no public registration.
3. Who may use it
Access is limited to authorised members of our organisation and people we have expressly invited. You must not share your credentials, and you must not attempt to access the Service or any data in it without authorisation. We may withdraw access at any time.
4. YouTube API Services
The Service uses YouTube API Services. By using it you agree to be bound by the YouTube Terms of Service and you acknowledge the Google Privacy Policy. You agree not to use the Service in any way that would breach those terms, including by scraping YouTube outside the API, by attempting to circumvent API quotas, or by using the data it returns for any purpose other than evaluating and approaching potential partners.
5. Acceptable use
You must not use the Service to:
- send unsolicited bulk messages to creators, or harvest contact details for resale
- build or distribute a competing dataset of YouTube channels
- make automated decisions about a person without human review — every assessment the Service produces is a proposal for a person to confirm or reject
- break any applicable law, or the terms of any third-party service it relies on
6. The data it produces
Channel assessments are estimates produced from public data and from inference. They may be wrong, out of date, or incomplete: subscriber counts and engagement change daily, and judgements about a channel’s subject matter or presentation format are inferred rather than measured. Nothing the Service outputs is a statement of fact about a channel or its owner, and it must not be treated as one. Decisions with consequences for another party remain the responsibility of the person who makes them.
7. Availability
The Service is provided on an “as is” and “as available” basis. It depends on third-party services, including the YouTube Data API and its daily quotas, and we give no warranty that it will be uninterrupted, timely or error-free. We may change, suspend or discontinue it at any time.
8. Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for lost profits, revenue, data or business opportunity, arising out of use of the Service. Nothing in these terms excludes liability that cannot be excluded under Slovak law, including liability for death or personal injury caused by negligence, or for fraud.
9. Intellectual property
The Service, its source code and its interfaces belong to us. Data retrieved from YouTube remains subject to YouTube’s terms and the rights of its owners; nothing here transfers any ownership in it.
10. Privacy
How we handle personal data, including how a channel owner can have their channel removed, is set out in our privacy policy, which forms part of these terms.
11. Governing law
These terms are governed by the laws of the Slovak Republic, and the courts of the Slovak Republic have exclusive jurisdiction over any dispute arising from them.
12. Changes
We may update these terms. The effective date above shows when they last changed, and continued use of the Service after a change means you accept the updated terms.
